Colchester City Council’s Submission Draft Local Plan is in its Regulation 19 consultation window. This is the advanced draft the council intends to submit for independent examination. Comments close at 4pm on Tuesday 13 October 2026. After that deadline, late representations are not accepted under the council’s Statement of Representations Procedure.
This piece is a how-to for businesses that still need to lodge a comment. It is not an impact essay on growth or infrastructure charging. If your firm occupies premises, holds employment land, or is watching allocations near your site, the practical questions are simpler: how do you submit, what should you read first, and how do you frame a representation the Inspector can use.
What Regulation 19 is asking for
Under Regulation 19 of the Town and Country Planning (Local Planning) (England) Regulations 2012, the council is inviting comments on whether the Submission Draft is legally compliant and sound. The portal states that this is the last opportunity to comment before the plan is submitted to a planning inspector. Your representation is reviewed by the council and is also passed on as part of the examination material.
That framing matters. A general complaint about traffic, housing numbers, or “too much development” is weaker than a focused point that names the policy or site, says whether the issue is legal compliance or soundness, explains why, and (where you can) states the modification you want the Inspector to consider.
In plain English, legal compliance is about whether the plan has been prepared in line with the right laws and procedures. Soundness is about whether the plan is positively prepared, justified, effective, and consistent with national policy (the tests the examination will apply). You do not need legal jargon. You do need to be specific.

The same closing time also applies to related Regulation 19 documents listed on the portal, including the Sustainability Appraisal and Habitats Regulations Assessment. If your point is really about the plan’s policies or maps, comment on the Submission Draft itself. Avoid duplicating the same text across every supporting document unless you have a distinct point about that document.
Portal steps (register, find the policy, submit)
The council’s online instructions are straightforward. You can read the plan and view published comments without an account. You need to register and log in only if you want to make a representation.
- Open https://colchester.oc2.uk and use the links in the top security bar to register or log in.
- From the homepage, open the Colchester Submission Draft Local Plan Regulation 19 Consultation 2026 document.
- Use the contents list to open the chapter, policy, site, or issue that affects you.
- Click the Comment button next to that item and complete the online representation form.
- Where a map icon appears, open it so you are commenting on the correct boundary, not a neighbouring allocation.
- Submit in good time. Do not leave it until the last hour of a busy Tuesday afternoon.
If the form asks you to say whether you are supporting, objecting, or commenting, answer honestly. If it asks about legal compliance and soundness, tick the boxes that match your point and use the free-text fields to explain. Keep a copy (screenshot or PDF print) of what you submitted and the time.

What “duly made” means in plain English
In plan-making language, a duly made representation is one that counts: it was submitted in the right way, within the published period, and in a form the authority can process and send to the Inspector.
For a busy Colchester firm, that usually means:
- It arrives by 4pm on 13 October 2026 (not “sometime that week”).
- It is lodged through the published consultation route (the oc2 portal is the route the council is using for this consultation).
- It is about the published Submission Draft (or a clearly identified related Regulation 19 document), not a private email thread or a social media post.
- It is clear enough to show what part of the plan you are talking about and whether your point goes to legal compliance, soundness, or both.
Duly made representations travel with the plan into examination. People who make Regulation 19 representations may also be invited to take part in hearing sessions later. If appearing at examination matters to your business, this is the stage at which the representation needs to be on the record. Informal remarks after the deadline will not fix a missed submission.
Which policies firms should skim first (premises and employment land)
You do not need to read the whole plan cover to cover before commenting. For most businesses concerned with premises, yards, offices, industrial floorspace, or employment allocations, start with these published plan parts on the portal:
- Policy ST6: Colchester’s Employment Needs (strategic employment land quantum and the approach to meeting demand to 2043, including Table ST6.1 site list material in the plan text).
- Policy E1: Protection of Employment (safeguarding of employment land and premises, and the tests for redevelopment or change of use).
- Policy E2 and related economy chapter material (economic development in rural areas and the countryside, if your premises sit outside the urban core).
- Any site-specific or opportunity-area policy that covers your address, neighbouring land, or a site you trade beside (for example employment or mixed-use policies linked to named locations such as Northern Gateway, Knowledge Gateway / University area, or other allocated employment sites listed in the plan).
- The policies map for your parcel, so you know whether land is shown as safeguarded employment, an allocation, or something else.
When you skim, check three practical things: Is your site named or mapped? Do the use-class expectations (such as E(g), B2, B8 where the plan refers to them) match how you occupy or intend to use the premises? Has the wording changed from earlier Preferred Options material in a way that affects you?
If you support a policy (for example because it protects your estate from piecemeal loss), say so. Supportive representations are as valid as objections. If you object, say what change would make the plan sound or legally compliant from your perspective: a wording tweak, a boundary correction, a clearer criterion, or recognition of an omission. Point to evidence where you can (your own marketing record, floorspace data, or a published evidence document on the New Local Plan hub), but keep the representation readable.
A short checklist before you press submit
- Name the policy number or site in the first paragraph.
- State legal compliance, soundness, or both.
- Explain the problem or support point in one clear sequence of paragraphs.
- Say what modification (if any) you want.
- Confirm the comment is attached to the correct portal item, not a neighbouring policy.
- Submit before 4pm on Tuesday 13 October 2026.
- Save confirmation for your records.
After you comment
Once the window closes, the council processes representations and moves toward submission for examination. Published comments on the portal are moderated before they appear, so a newly posted remark may not show immediately. That delay is normal; it is not a reason to resubmit the same text repeatedly.
If several businesses on the same estate share a concern, each can still submit its own representation. Coordinated wording is fine. Identical copy-paste dumps across every chapter are less helpful than one clear representation on the policy that actually bites.
The consultation is still open. For firms that have not yet looked at ST6, E1, or their site policy, the remaining weeks are enough to read the relevant pages, draft a focused representation, and lodge it through colchester.oc2.uk before the 4pm cut-off on 13 October.
